Floral Preservation Agreement
Bark and Boards LLC
This Floral Preservation Agreement (“Agreement”) is entered into by and between Bark and
Boards LLC (“Company”) and the undersigned Client.
1. Scope of Services
Bark and Boards LLC agrees to professionally preserve the Client’s florals and create the
custom floral preservation piece or pieces selected by the Client, as outlined in the approved
invoice.
Client understands and acknowledges that flowers are natural, organic materials and that
exact replication of their original color, shape, texture, or appearance cannot be guaranteed.
2. Retainer and Payment Terms
A non-refundable retainer is required to reserve the Client’s preservation date and secure
placement in the Company’s production schedule.
The retainer compensates the Company for design planning, studio scheduling, material
allocation, and reservation of production capacity.
The remaining balance is due prior to delivery or shipment of the finished piece or pieces. No
finished item will be released until the balance has been paid in full.
3. Floral Condition Disclaimer
Client understands and agrees that flowers are delicate organic materials and natural
changes occur during preservation. Color shifts are common: whites may ivory or cream, reds
may deepen, and blue or purple flowers may darken.
Bruising, browning, spotting, translucency, or other natural variations may occur during the
preservation process.
The Company is not responsible for any damage, deterioration, or loss in quality that occurs
prior to the florals being received by Bark and Boards LLC.
4. Delivery of Florals
Client agrees to deliver or ship florals to Bark and Boards LLC within one (1) to three (3)
days following the event unless otherwise agreed in writing.
Client agrees to follow any preparation, packaging, and shipping instructions provided by the
Company.
If florals are shipped, risk of loss or damage during transit remains with the Client until the
florals are received by Bark and Boards LLC.
5. Artistic Discretion
Each preservation piece is custom, handmade, and one-of-a-kind. Client grants Bark and
Boards LLC artistic discretion in the design, layout, placement, and composition of the
preserved florals.
Minor bubbles, subtle surface variations, and natural irregularities are inherent characteristics
of handmade resin art and are not considered defects.
6. Production Timeline
Typical completion timeframe is approximately four (4) to eight (8) months, depending on
the size, complexity, and curing requirements of the selected piece or pieces.
All production timelines are estimates and are not guaranteed.
7. Cancellation Policy
The retainer is non-refundable under all circumstances.
If the Client cancels the order after production has begun, all payments made up to that point
shall be non-refundable due to the custom nature of the work and the materials, labor, and
production time already invested.
8. Limitation of Liability
In the unlikely event of catastrophic failure during the preservation process, Bark and Boards
LLC’s liability shall be limited to a refund of the amounts paid by the Client for the affected
piece or pieces.
Bark and Boards LLC shall not be liable for the sentimental or emotional value of the florals.
9. Photography and MarketingUnless otherwise requested in writing, the Client grants Bark and Boards LLC permission to
photograph the florals, works in progress, and finished preservation pieces for portfolio,
website, social media, and marketing purposes.
10. Acceptance
By signing below, the Client acknowledges that they have read, understood, and agreed to
the terms of this Agreement.
